ALERT: Supreme Court Limits The Use of Universal/Nationwide Injunctions
The Birthright Citizenship Supreme Court Case - that isn't really a decision about birthright citizenship, but the use of universal/nationwide injunctions. The Supreme Court's decision today has limited the use of universal/nationwide injunctions, finding universal injunctions, "likely exceed the equitable authority that Congress has granted to federal courts."
This decision could have far-reaching implications to questions regarding access to justice and the speed at which courts can weigh in on issues in a way with nationwide implications. Universal injunctions have thwarted action on both sides of the aisle.
".... we do not address—the question whether the Executive Order violates the Citizenship Clause or Nationality Act. The issue before us is one of remedy: whether, under the Judiciary Act of 1789, federal courts have equitable authority to issue universal injunctions."
